CIVIL DEPUTY STATE'S ATTORNEY/SENIOR CIVIL DEPUTY STATE'S ATTORNEY

GENERAL INFORMATION:


The Minnehaha County State's Attorney's Office invites applications for a Civil Deputy/Senior Civil Deputy State's Attorney to perform professional legal work on behalf of Minnehaha County, County elected officials, and County department heads in civil and administrative proceedings.

The hiring range is $2,603.20 - $3,093.60 bi-weekly with a full earning potential of $3,768.80 biweekly. Consideration for appointment above the hiring range is dependent upon qualifications. 


EXAMPLES OF DUTIES INCLUDE:


Identifying, evaluating and mitigating against risk. Performing legal research and providing oral or written opinions to County officials and department heads. Negotiating, writing and reviewing a wide-array of contracts, ranging from purchase agreements to intergovernmental agreements. Drafting resolutions and ordinances. Handling real estate transactions. Reviewing or drafting requests for proposals and solicitations for bids. Attending meetings of the Board of County Commissioners, the Planning & Zoning Commission, the Minnehaha County Conservation District, or other public meetings. Preparing and conducting compliance trainings. Preparing and prosecuting civil complaints on behalf of the County. Conducting depositions and responding to subpoenas. Drafting responses to requests for information under the Open Records Act. Providing legal assistance with the development of policies and procedures in order to ensure compliance with federal, state and local laws. Staying informed on changes in relevant law, proposed legislation and policy pertaining to any matter which may impact county government. Providing legal consultation to the Human Resources Department on employment law matters. Answering, handling, or directing phone calls and walk-in traffic from clients and the general public regarding legal concerns and questions as related to the County. Handling the defense of habeas corpus petitions, including: writing motions, writing briefs, and conducting evidentiary hearings. Handling expungement proceedings. Handling hearings relating to return of firearms petitions

REQUIREMENTS
MINIMUM QUALIFICATIONS:

Graduation from a college of law. Attainment of a Juris Doctor degree from an accredited law school. Admission by the Supreme Court of South Dakota to practice law in the State of South Dakota or be licensed to practice law in any other state and able to take the next available South Dakota bar examination. Comparable combination of education and experience may be considered. Must successfully complete pre-employment background process. Consideration for appointment as a Senior Deputy State's Attorney requires a minimum of two years of relevant work experience. Working knowledge of civil law principles, methods, materials and practices utilized in legal research; and general law and established precedents. Ability to prosecute cases. Ability to speak and write effectively in the preparation and presentation of legal matters. Ability to establish and maintain effective working relationships with coworkers, other agencies and the public. Ability to maintain professional appearance and demeanor.

PREFERRED QUALIFICATIONS:

Four or more years of legal experience. Two or more years of legal experience as in-house corporate counsel or in the public sector representing a state or local governmental entity. Jury trial experience. Prior experience in the following subject areas: civil litigation, procurement, real estate, public records law, land use law, employment law, collective bargaining, and other laws affecting county government.
